A federal court issued an injunction against SKF USA Inc. barring it from distributing RBC Bearings Inc.’s Nice brand bearings line. The Federal District Court of Connecticut stopped the Swedish bearings manufacturer’s American division from selling the Oxford, Conn.-based manufacturer’s Nice line in a dispute over whether SKF USA is still an authorized distributor of the radial ball bearing products.
The court found that SKF USA’s price list and other marketing materials “2008 price list was missing a significant portion of RBC's product line,” making its distribution “far more damaging to RBC and more likely to create confusion,” according to a statement from RBC Bearings.
The injunction bars SKF USA from distributing its 2008 price list and product interchange document and from making any suggestion that the company is authorized to sell the RBC line unless the sales documents “clearly disclaim any authorized affiliation with the Nice brand and clearly disclaim any status as an authorized distributor of Nice products.”
